Terms & Conditions

By using this site, you (“the Client”) have agreed to the Terms and Conditions (“Conditions”) of use with South Coast Physio & Pilates who provide their service (“the Service”) on this website (www.southcoastphysiopilates.co.uk). Please do not use this site if you do not agree to all of the Terms and Conditions of this agreement. We may revise the Terms and Conditions in the future.

Disclaimer

By nature of the fact that the physiotherapists are not in direct contact with the Clients, the Service cannot meet the needs of every Client. Complete Physiotherapy will endeavour to provide online management/advice based on the information supplied along with any supplementary questions requested by the physiotherapist. However, if South Coast Physio & Pilates feel they cannot provide a reasonable level of service, perhaps because the Clients’ condition is too serious or inappropriate to be treated/advice provided online, South Coast Physio & Pilates will not proceed with the management/advice but may suggest that the Client take an alternative course of action.

Online physiotherapy management/advice can never be as comprehensive as a face-to-face appointment with a Chartered Physiotherapist.

Provision of online management/advice

South Coast Physio & Pilates will only provide online management/advice if the Client is eighteen (18) years or over. Once we have evaluated the information sent by the Client, we may decide we are unable to provide acceptable management/advice online, in which case we will advise accordingly.

Delivery

We will endeavour to deliver our email management/advice responses to clients within 3 working days of the information being received, or, if applicable, within 3 working days of the subsequent questions raised by the physiotherapist being answered by the client. For the purpose of this agreement, working days exclude Saturdays, Sundays & UK Public holidays.

Limited liability

To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from South Coast Physio & Pilates negligence, South Coast Physio & Pilates hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Service, and any information, content, advertisements or products provided or distributed through the Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to South Coast Physio & Pilates. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.

Indemnity

By using the Service you agree to defend, indemnify and hold South Coast Physio & Pilates, its officers, partners, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Content in a manner that violates or is alleged to violate these Conditions.

 

General

These Conditions constitute the entire agreement between you and TSouth Coast Physio & Pilates and govern your use of the Service, superseding any prior agreements between you and South Coast Physio & Pilates. The Conditions and the relationship between you and the Barnes Physiotherapy Practice shall be governed by the laws of England. You and South Coast Physio & Pilates agree to submit to the exclusive jurisdiction of the English courts. Any failure by South Coast Physio & Pilates to exercise or enforce any right or provision of the Conditions shall not constitute a waiver of such right or provision. If any provision of the Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect
